6 February 2014, Hong Kong wins Trade Finance award

The Structured Trade Finance team in Hong Kong have been awarded Asia Pacific Deal of the Year by Trade Finance magazine in their annual awards.

The winning transaction, led by partner Jolyon Ellwood-Russell and supported by Catherine Arlin in the Hong Kong Finance & Projects team, was for acting as lead counsel to the Bookrunners and Arrangers comprising of ABN AMRO Bank N.V., Natixis and Société Générale on a syndicated US$195m commodity prepayment facility for Xinjiang Zhaokun Trading Co. Ltd, an aluminium producer in the Kashgar province of the People's Republic of China, to finance the purchase and production of aluminium.

The transaction attracted high praise for its complex structure and incorporated hybrid loan characteristics with prepayment features, pre-export finance features (in relation to the commodity offtake arrangements) and balance sheet loan features devised specifically to meet PRC onshore lending and PRC regulatory (SAFE) requirements.

The Asian Financial Forum 2014 (AFF 2014), organized by Hong Kong Trade Development Council (HKTDC), took place at Hong Kong Convention and Exhibition Centre on 13 - 14 January, 2014. This forum brought together some of the most influential members of the global financial and business community to discuss the economic opportunities in Asia and the rest of the world. Given Jolyon Ellwood-Russell's experience in Trade Finance around Asia and in particular China, he was invited to participate in the programme on "Strategic opportunities with the upcoming ASEAN Economic Community" which sets the stage for dialogue on the opportunities in China and the landscape of business investment and trade in Asia.

On 15 - 17 October, The Exporta Group organized the 3rd Annual China Trade & Export Finance Conference in the Swissotel, Beijing. This is the only trade and export finance event for the China market, which provides a prime opportunity for delegates to meet with both regional and international trade finance heads and industry leaders.

Over 160 delegates attended this conference including clients from Bank of America Merrill Lynch, ANZ, BOC, Deutsche Bank, FIMbank, Citi, NAB, PICC, Standard Chartered and Westpac.

The conference consisted of a host of expert speakers from the banking, corporate, insurance, legal and financial services sectors, discussing the most pertinent industry issues through detailed presentations and debate-driven panel discussions. Jolyon Ellwood-Russell gave an presentation titled "Commodity Finance in PRC". He shared his thoughts on the current offshore funding solutions being used for prepayments in China and defined the roles of borrowers, banks, offtakers and advisors, documenting performance risk and securing payment risk as well as highlighting the importance of designing and implementing innovative and regulation-compliant risk mitigation structures.

January to May 2013
DLA Piper lawyer Catherine Arlin has undertaken a four-month secondment with HSBC Hong Kong, during which she advised the Global Trade & Receivables Finance team on legal issues relating to domestic and cross-border receivables finance. Since her return from secondment, Catherine has been working closely with Partner Jolyon Ellwood-Russell in Hong Kong.

DLA Piper Associate James Willcock has moved from Hong Kong to the London office whilst Associate Catherine Arlin has moved from London to Hong Kong. Both remain part of the firm's newly merged Structured Trade and Receivables Finance team. Alex Dell, Head of the Structured Trade and Receivables Finance team in London, commented "The recent merger of our Structured Trade and Receivables Finance practices reflects our commitment to service our clients' increasing requirements for a consolidated offering in these areas across the jurisdictions in which they operate. James's and Catherine's moves represent a significant part of our delivery on that commitment." James will work closely with Partner Alex Monk in London whilst Catherine will work closely with Partner Jolyon Ellwood-Russell in Hong Kong.
